but it depends i guess on time.
when The Force Unleashed demo came out, only gold subscribers could download it, but after a while, it was available to silver members too, so im not sure.

i'd say if you can, just jump online and check the marketplace.
you should be able to access the marketplace on xbox.com too.

You can buy the disk in stores for about 15$ CAN but it is still useless without live.
